Misdemeanor possession of Marijuana in Dallas County

Currently 23 states have legalized marijuana in one form or another. Texas is not one of those states. Like it or not, possession of marijuana is a crime in Texas. Possession of under two ounces is punishable up to 180 days in jail, and 2-4 ounces is punishable up to one year. Possession of more than 4 ounces is a felony. This article only address' how the Dallas County DA's offices handles misdemeanor possession of marijuana, not felony possession. In short, the Dallas County DA's is not looking to throw the book at anyone charged with misdemeanor possession of marijuana. In 2015, every FIRST time possession of marijuana case I have handled has been disposed in one of three ways. 1) a conditional dismissal, 2) a memo agreement dismissal, and 3) a reduction to deferred on the class C offense of possession of paraphernalia.
